1. Agreement to Terms
By accessing or using the ReShelvd mobile application (“the App”), you agree to be bound by these Terms of Service. These Terms constitute a legally binding agreement between you and Commonshelf Pty Ltd. If you do not agree with all of these terms, you are prohibited from using the App.
You must be at least 16 years of age to use the App.
2. The Service (Facilitator Only)
ReShelvd is a platform that allows users to catalog physical books via automated book recognition technology and discover nearby users for the purpose of trading books.
- No Agency: Commonshelf Pty Ltd is a facilitator only. We are not a party to any trade, sale, or exchange between users.
- No Guarantee: We do not verify the condition, authenticity, or existence of books listed. All trades are “as-is” and at the user’s own risk.
- No Mediation: We do not provide dispute resolution or “trade protection” for damaged, lost, or unreturned items.
- In-App Messaging: The App provides a messaging feature for users to communicate about potential trades. Commonshelf Pty Ltd does not monitor message content but reserves the right to review messages in response to reports of abuse.
3. Location Sharing & Privacy
To enable local trading, the App utilizes location services.
- Obfuscation: To protect user privacy, all map pins are subject to a randomized offset. The App does not display your exact street address to other users.
- User Responsibility: You acknowledge that even with obfuscation, a library location may be used to approximate your general vicinity. You are encouraged to meet in public, well-lit “Safe Trade” locations (e.g., libraries, cafes) for physical exchanges.
- Assumption of Risk: Commonshelf Pty Ltd is not liable for any unauthorized visits, stalking, or harassment resulting from your choice to participate in a location-based marketplace.
4. “ReShelvd Unlimited” Subscription
We offer a premium tier, ReShelvd Unlimited, for $0.99 AUD/USD per month (price may vary by region).
- Features: Includes unlimited library entries and the ability to initiate trades with any user.
- Billing: Payments are processed via the Apple App Store or Google Play Store. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- Cancellation: You may cancel at any time via your device’s subscription settings. Refunds are handled in accordance with the applicable app store’s refund policies and your rights under Australian Consumer Law.
5. User Conduct & Content
- Scanning: You may only scan books that you physically own or have the right to trade.
- Prohibited Items: You may not list illegal, stolen, or infringing materials.
- Community Safety: Harassment, fraud, or the use of the App to scrape user data is strictly prohibited and will result in an immediate permanent ban.
- Age Requirement: You confirm that you meet the minimum age requirement set out in Section 1.
6. Intellectual Property
The App’s code, design, branding, and book identification features are the exclusive property of Commonshelf Pty Ltd. Users are granted a limited, non-exclusive license for personal use only.
7. Limitation of Liability
- Australian Consumer Law: Nothing in these Terms excludes any guarantees or remedies provided under the Competition and Consumer Act 2010 (Cth) that cannot be legally excluded.
- General Limitation: To the maximum extent permitted by law, Commonshelf Pty Ltd shall not be liable for any physical injury, property damage, or financial loss resulting from:
- User-to-user interactions or physical meetings.
- The inaccuracy of the map location offset.
- App downtime or data loss.
- Liability Cap: Our total liability for any claim is limited to the amount paid by you for the “ReShelvd Unlimited” subscription in the 12 months preceding the claim.
8. Data Privacy (International Standards)
We process data in accordance with the Australian Privacy Principles (APP) and aim to respect international privacy standards.
- We collect location data for functional purposes (such as discovering nearby books) and only display approximate location data to other users.
- Users have the right to delete their account and all associated data at any time via the App settings.
- Third-Party Services: The App uses third-party service providers for backend infrastructure, book metadata, and payment processing. These providers may process your data in accordance with their own privacy policies.
9. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of NSW.
10. Amendments
We reserve the right to modify these Terms at any time. We will notify users of significant changes via in-app notifications. Continued use of the App following changes constitutes acceptance of the new Terms.
11. Dispute Resolution; Class Action Waiver (U.S. Users)
If you are a resident of the United States (or using the App within the U.S.), the following applies:
- Binding Arbitration: You and Commonshelf Pty Ltd agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof (collectively, “Disputes”) will be settled by binding arbitration, except that each party retains the right to bring an individual action in small claims court.
- Class Action Waiver: YOU AND COMMONSHELF PTY LTD AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Commonshelf Pty Ltd agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.
- Jury Trial Waiver: You acknowledge and agree that by entering into these Terms, you and Commonshelf Pty Ltd are each waiving the right to a trial by jury.
